Scope of application and definitions<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">2.1. These General Terms and Conditions of Sale apply to all distance sales contracts concluded through the Site between the Seller and the Customer acting as a consumer, that is, a natural person purchasing for purposes unrelated to any business, commercial, craft or professional activity carried out (hereinafter the \u201cCustomer\u201d or the \u201cConsumer\u201d), pursuant to Article 3 of Legislative Decree No. 206 of 6 September 2005 (hereinafter the \u201cConsumer Code\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2. Sales made through the Site constitute distance contracts governed by Articles 45 et seq. of the Consumer Code and by Legislative Decree No. 70 of 9 April 2003 on electronic commerce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3. Placing an order on the Site implies full knowledge and acceptance of these General Terms and Conditions of Sale. The Seller invites the Customer to read them carefully before proceeding with the purchase and to print or save a copy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.4. These terms may be amended at any time. Any changes will take effect from the moment they are published on the Site and will apply only to orders placed after such publication.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>3. Products and prices<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. The Site offers for sale boots, frames, wheels, bearings, brakes, spare parts, accessories, apparel and complete skates for competitive roller skating. The essential characteristics of each product are shown on the relevant product page. Images are purely indicative: minor differences in color or appearance may depend on the device used for browsing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.2. All prices are expressed in Euros. On the product page the price is shown both net and gross of VAT; the price applied to the order is the VAT-inclusive price displayed at the time of order confirmation. Any shipping costs are shown separately in the order summary before the order is finalized.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.3. The Seller reserves the right to change prices at any time; in any case, the price applied to ordered products is the price indicated at the time the order is submitted, regardless of any subsequent changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.4. For all shipments outside the European Union, any customs duties, import taxes, local taxes and customs clearance fees applied by the authorities of the destination country are the sole responsibility of the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such amounts are not included in the price of the products or in the shipping costs shown at the time of the order. The Customer is advised to check in advance with the relevant customs authorities of their own country.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>4. Formation of the contract<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. To place an order, the Customer selects the products, adds them to the cart and follows the guided purchase procedure, providing the information required for billing, shipping and payment. Before submitting the order, the Customer can review the summary and correct any input errors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.2. The contract is deemed concluded when the Seller sends the Customer, at the email address provided, an order confirmation containing a summary of the applicable terms, information on the essential characteristics of the products, details of the price, payment methods and delivery costs, as well as information on the right of withdrawal, pursuant to Article 51, paragraph 7 of the Consumer Code.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.3. The Seller reserves the right not to accept anomalous orders or in the event of subsequent unavailability of products. In such cases, the Seller will promptly notify the Customer and fully refund any amount already paid.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>5. Payment methods<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. Payment can be made using the following methods:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Credit card, through certified payment circuits with a secure connection. Card details are managed directly by the payment service provider and are not stored by the Seller in any way.<\/li>\n\n\n\n<li>Advance bank transfer. Bank details are provided to the Customer at the end of the order; the order is processed once payment is actually credited, which must occur within 7 working days of order confirmation, after which the order is deemed cancelled.<\/li>\n<\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>6. Shipping and delivery<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">6.1. The Seller ships within Italy and worldwide. Shipments are entrusted to express couriers and, where provided by the selected service and available for the destination country, include a tracking code.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2. Delivery within Italy is free for orders over 100 Euros, VAT included. For orders below this amount and for shipments abroad, shipping costs vary depending on the destination country and are shown in the order summary before the order is finalized.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.3. Delivery times shown on the Site are purely indicative and run from the time the shipment is taken in charge by the courier. In any case, pursuant to Article 61 of the Consumer Code, delivery takes place within 30 days of the conclusion of the contract, unless otherwise agreed with the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.4. Upon delivery, the Customer is advised to check the integrity of the packaging. In the presence of evident damage, the Customer may accept delivery with reservation or refuse it, promptly notifying the Seller at info@roller-mania.it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.5. The risk of loss or damage to the products passes to the Customer only when the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the goods.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>7. Right of withdrawal<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">7.1. Pursuant to Articles 52 et seq. of the Consumer Code, the Customer who is a Consumer has the right to withdraw from the contract, without giving reasons and without penalty, within 14 days from the day on which the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods. In the case of an order for multiple goods delivered separately, the period runs from the delivery of the last item.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.2. To exercise the right of withdrawal, the Customer may choose to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>notify the intention to exercise the right of withdrawal by sending an explicit statement to the email address info@roller-mania.it, indicating the order number, identifying details and the products for which withdrawal is sought. The Seller will contact the purchaser to arrange the return process.<\/li>\n\n\n\n<li>download the specific withdrawal form available on the Site, fill it out in full and send it to the email address info@roller-mania.it<\/li>\n\n\n\n<li>send any other explicit statement of the decision to withdraw, by email to info@roller-mania.it or by certified email (PEC) to rollermaniasrl@pec.confartigianatoprato.it.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">7.3. The Customer must return the goods to the Seller, at Rollermania S.r.l., Via Pistoiese 692, 59100 Prato (PO), Italy, without undue delay and in any case within 14 days from the date on which the Customer notified the intention to exercise the right of withdrawal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The direct costs of returning the goods are borne by the Customer. The Customer is free to choose the carrier, provided that the shipment of the returned products is at the Customer&#8217;s own risk until delivery to the Seller.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The operating procedures and instructions for making the return are communicated to the Customer following receipt of the withdrawal notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.4. The Seller shall refund payments received without undue delay and in any case within 14 days from the day on which it is informed of the withdrawal. The refund will be made using the same payment method used for the purchase, unless otherwise agreed with the Customer and without additional costs. Additional costs resulting from the choice of a delivery method other than the standard method offered by the Seller, and more expensive than it, will not be refunded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.5. The Customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning. Products must be returned intact, complete with all their parts and accessories, unused and, where possible, in their original packaging.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>8. Exclusions from the right of withdrawal<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">8.1. Pursuant to Article 59, letter c) of the Consumer Code, the right of withdrawal is excluded for the supply of goods made to measure or clearly personalized.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.2. This exclusion applies, in particular, to complete skates configured and assembled to the Customer&#8217;s specifications, that is, skates made by combining boot, frame, wheels, bearings and other components chosen by the Customer through the configurator or upon their express request. Such products are not refundable and cannot be subject to withdrawal. This exclusion is clearly indicated on the relevant product page and in the order summary before the order is finalized.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.3. The exclusion of the right of withdrawal does not in any way affect the legal guarantee of conformity referred to in Article 9.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>9. Legal guarantee of conformity<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">9.1. All products sold on the Site are covered by the legal guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code, which protects the Consumer in the event of defects of conformity existing at the time of delivery and appearing within 2 years of that time. The defect must be reported to the Seller, who is liable to the Consumer in accordance with the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.2. In the event of a defect of conformity, the Customer is entitled to have conformity restored through repair or replacement of the item, or, in the cases provided for by law, to an appropriate price reduction or termination of the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.3. To make use of the guarantee, the Customer may contact the Seller at info@roller-mania.it, indicating the order number and describing the defect found, attaching photographic documentation where possible. Shipping costs relating to work carried out under the guarantee are borne by the Seller.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.4. The guarantee does not cover defects arising from improper use, ordinary wear of components subject to consumption (for example wheels, brakes, bearings and laces worn through normal use), inadequate maintenance, or unauthorized modifications or repairs.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>10. Liability<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">10.1. The products sold on the Site are intended for the sporting practice of skating. The Customer must use them in accordance with the manufacturer&#8217;s instructions, ensure proper maintenance, and use appropriate protective gear during sporting activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.2. The Seller is not liable for delays or failures to perform due to unforeseeable circumstances or force majeure. Nothing in these terms excludes or limits the Seller&#8217;s liability in cases where the law does not permit such exclusion or limitation.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>11. Processing of personal data<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">11.1. The Customer&#8217;s personal data is processed by the Seller in accordance with EU Regulation 2016\/679 (GDPR) and Legislative Decree 196\/2003, for the purposes and in the manner described in the Privacy Policy published on the Site, which the Customer is invited to consult.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>12. Complaints and alternative dispute resolution<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">12.1. For any complaint or request for assistance, the Customer may contact the Seller at info@roller-mania.it or by phone at 0574 651341. The Seller will respond to complaints as promptly as possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.2. Consumers residing in the European Union may make use of the alternative dispute resolution (ADR) procedures referred to in Part V, Title II-bis of the Consumer Code, by contacting the competent ADR bodies. The Seller will provide information on available bodies upon request.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>13. Governing law and jurisdiction<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">13.1. These General Terms and Conditions of Sale are governed by Italian law, without prejudice to the application of any more favorable and mandatory consumer protection rules in force in the country of the Customer&#8217;s habitual residence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.2. For any dispute relating to the application, performance and interpretation of these terms, the competent court is that of the place of residence or domicile of the Consumer, if located in Italian territory.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Attachment: Standard withdrawal form<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\"><em>(pursuant to Article 49, paragraph 1, letter h) of the Consumer Code.
